By accessing and using the services provided by maammsnt B.V. ("maammsnt," "we," "our," or "us"), including our website at maammsnt.top and fitness coaching services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Description of Services

maammsnt provides professional fitness coaching services, including but not limited to:

• Personal training sessions
• Group fitness training
• Nutrition coaching and guidance
• Fitness assessments and consultations
• Online resources and educational materials

Our services are designed to help clients achieve their fitness and wellness goals through professional guidance and evidence-based training methods.

User Obligations and Responsibilities

By using our services, you agree to:

• Provide accurate and complete information about your health status and fitness goals
• Follow safety guidelines and instructions provided by our coaches
• Inform us of any changes to your health condition or medical status
• Attend scheduled sessions punctually and provide reasonable notice for cancellations
• Treat our staff and facilities with respect
• Comply with all applicable laws and regulations
• Not engage in any behaviour that could harm other clients or staff

You are responsible for ensuring that you are physically capable of participating in fitness activities and should consult with a healthcare provider before beginning any exercise programme.

Health and Safety Disclaimer

Participation in fitness activities involves inherent risks. By using our services, you acknowledge and accept these risks. You represent that:

• You are in good physical condition and have no medical conditions that would prevent safe participation
• You will immediately inform us of any discomfort, pain, or unusual symptoms during training
• You understand that results may vary and are not guaranteed
• You will seek medical advice before starting if you have any health concerns

Our coaches are qualified fitness professionals, but they are not medical doctors. Our advice is for fitness and wellness purposes only and does not constitute medical advice.

Payment Terms and Cancellation Policy

Payment for services is due according to the agreed schedule. Our payment and cancellation policies include:

• Fees must be paid in advance for scheduled sessions or packages
• Cancellations must be made at least 24 hours in advance to avoid charges
• No-shows may be charged the full session fee
• Refunds are provided according to our specific refund policy
• Late payment may result in suspension of services

Specific payment terms and cancellation policies will be provided in your service agreement.

Intellectual Property

All content provided by maammsnt, including but not limited to training programmes, educational materials, website content, logos, and proprietary methodologies, is protected by intellectual property laws and remains the exclusive property of maammsnt.

You may not:

• Reproduce, distribute, or commercially exploit our proprietary content
• Share training programmes or materials with third parties
• Use our branding or intellectual property without written permission
• Reverse engineer or copy our methodologies for commercial purposes

Any feedback or suggestions you provide may be used by maammsnt without compensation or attribution.

Privacy and Data Protection

Your privacy is important to us. The collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy, including health and fitness data necessary for providing effective coaching services.

Limitation of Liability

To the maximum extent permitted by law, maammsnt shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to:

• Personal injury or property damage
• Loss of profits or business opportunities
• Emotional distress or mental anguish
• Failure to achieve desired fitness results
• Interruption or suspension of services

Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific service giving rise to the claim.

This limitation applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain liability limitations, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless maammsnt, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination

Either party may terminate the service relationship at any time with appropriate notice. maammsnt reserves the right to immediately terminate or suspend your access to our services if you:

• Violate these Terms or our policies
• Engage in unsafe or inappropriate behaviour
• Fail to pay fees when due
• Provide false or misleading information
• Threaten or harm staff or other clients

Upon termination, your right to use our services ceases immediately, and any outstanding fees become due and payable.

Force Majeure

maammsnt shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, government regulations, pandemic restrictions, or other acts of God.

Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Severability

Entire Agreement

These Terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and maammsnt regarding the use of our services and supersede all prior agreements and understandings.
